# YESMOMENT.CO COMPREHENSIVE TERMS OF SERVICE, PRIVACY PROTOCOLS, AND OPERATIONAL FRAMEWORK
The following stipulations constitute a legally binding contractual arrangement governing the holistic utilization of the YesMoment.co digital infrastructure. By engaging with the interactive modules of this platform, whether through authenticated login, the acquisition of digital credits, or the systematic retrieval of lead-based data parameters, the user (hereinafter referred to as "the Artist," "the Photographer," or "the User") hereby acknowledges a comprehensive understanding of these multi-faceted regulatory frameworks. This document is predicated upon the irrevocable premise that subsequent to the aforementioned effective date, any previous iterations of service agreements, including but not limited to gratuitous listing models or non-commercial introductory protocols, have been systematically superseded by the commercial marketplace structure defined herein. The User’s continued presence within the architectural confines of the Dashboard serves as a definitive and legally conclusive affirmation of their transition into the "Pay-per-Lead" ecosystem, thereby waiving any prospective claims regarding prior non-monetized arrangements or historical service precedents.

### SECTION 1: SYSTEMIC EVOLUTION AND COMMERCIAL TRANSITION
**1.1. Strategic Paradigm Shift:** As of the stipulated effective date, the Platform has formally completed its transition from an open-access introductory directory to a high-end, credit-based commercial marketplace.
**1.2. De Facto Acceptance:** The User explicitly acknowledges that the act of accessing the Artist Dashboard, subsequent to the notification of these updated parameters, constitutes a legally binding "de facto" acceptance of the new fee-based architecture.
### SECTION 2: VIRTUAL WALLET, DIGITAL CREDITS, AND FISCAL NON-LIABILITY
**2.1. Nature of Digital Assets:** Wallet credits represent an internal, non-redeemable digital tokenization system. These credits do **NOT** constitute legal tender or any form of financial asset with external monetary value.
**2.2. Irrevocable Transaction Policy:** All fiscal contributions directed toward the replenishment of the virtual Wallet are categorized as "immediate service consumption." Consequently, all top-ups are **FINAL AND NON-REFUNDABLE**.
**2.3. Zero Cash-Out Protocol:** Wallet balances may not be withdrawn, transferred, or redeemed for cash. Credits have zero value outside the proprietary ecosystem of YesMoment.co.
**2.4. Chargeback and Dispute Protection:** The Artist acknowledges that all Wallet top-ups are for immediate digital access to the Platform’s information services. By completing a transaction, the Artist explicitly waives the right to initiate a "chargeback" or "dispute" with their credit card issuer or bank for services already rendered. In the event of an unauthorized chargeback attempt, YesMoment.co reserves the right to: (a) permanently terminate the Artist’s account; (b) provide this signed Agreement and access logs (IP address, timestamps, and data delivery records) to the financial institution as definitive proof of service delivery; and (c) seek recovery of the disputed amount plus administrative legal fees in the Courts of Istanbul.
### SECTION 3: LEAD AUTHENTICITY AND RISK ASSUMPTION
**3.1. Absence of Warranty:** YesMoment.co provides access to information "as is." The Platform does **NOT** warrant the veracity, intent, or response-readiness of any Lead.
**3.2. Purchase of Access:** The Artist acknowledges that the "Unlock" is a purchase of *data access*, not a purchase of a *guaranteed booking*. Failure of a Client to respond is a recognized commercial risk solely borne by the Artist.
**3.3. Non-Exclusivity:** Leads are distributed on a non-exclusive basis and may be unlocked by multiple Artists simultaneously.
### SECTION 4: CONTENT LICENSING, MARKETING RIGHTS, AND MODIFICATION (CRITICAL)
**4.1. Irrevocable Marketing License:** By uploading Content to the Platform, the Artist grants YesMoment.co a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and transferable license to use, reproduce, modify, adapt, and display such Content.
**4.2. Right to Edit and Adapt:** YesMoment.co shall have the absolute right to edit, crop, modify, adapt, or enhance the Content for marketing, promotional, or technical purposes across all media formats without requiring prior approval or providing additional compensation.
**4.3. Warranty of Rights and Model Releases:** The Artist explicitly warrants that they are the sole owner of all intellectual property rights and have obtained all necessary **Model Releases** and explicit consent from any individuals depicted in the Content.
**4.4. Absolute Disclaimer for Image Subject Claims:** In the event of a claim regarding privacy or likeness, the Artist agrees to assume full legal and financial responsibility. YesMoment.co shall be held entirely harmless.
### SECTION 5: GOVERNING LAW AND EXCLUSIVE JURISDICTION (ISTANBUL)
**5.1. Choice of Law:** This agreement shall be governed exclusively by the laws of the **Republic of Türkiye**.
**5.2. Mandatory Jurisdiction:** Any legal suit or proceeding shall be instituted exclusively in the **Central Courts and Execution Offices of ISTANBUL (Çağlayan and Bakırköy), TÜRKİYE**.
**5.3. Prevailing Language:** In the event of any discrepancy between the English version and any translated version of these Terms, the English version shall prevail.
