### SECTION 1: FOR ALL USERS & CLIENTS
**1. Our Service: A Curated Introduction Platform**
YesMoment.co is a curated platform that provides an introductory and referral service to connect individuals ("Clients") with professional photographers ("Photographers" or "Artists") for surprise proposal moments. Our role is strictly limited to making this introduction based on our curation and expertise.
**2. The Booking and Service Process**
YesMoment.co is NOT a party to any agreement, contract, or transaction between the Client and the Photographer. All aspects of the photography service, including but not limited to scheduling, pricing, specific deliverables, and artistic direction, are to be agreed upon directly between the Client and the Photographer.
**3. Payments, Cancellations, and Refunds**
All financial transactions are conducted directly between the Client and the Photographer. The Platform does not process payments for photography services, handle bookings, or manage cancellations. Consequently, YesMoment.co has no cancellation or refund policy. All such policies must be established directly with your chosen Photographer before entering into an agreement. We hold no liability for financial disputes.

### SECTION 2: PRIVACY POLICY
**4. Our Commitment to Your Privacy**
YesMoment.co respects your privacy and is committed to protecting your personal data in compliance with standards like the General Data Protection Regulation (GDPR).
**5. What Data We Collect**
* **From Clients:** Name, email address, and details of the requested service (e.g., city, date) to facilitate an introduction to a Photographer.
* **From Photographers:** Name, email address, portfolio, website, and city of service to create your profile and feature you on the Platform.
* **Technical Data:** We may collect non-personal data like browser type or IP address to improve our service.
**6. How We Use Your Data**
Your data is used exclusively to:
* Facilitate and manage the introduction process between Clients and Photographers.
* Communicate with you regarding your request or your profile on the Platform.
* Improve the functionality and user experience of our Platform.
* Send you occasional marketing or informational emails, from which you can opt-out at any time.
**7. Data Sharing and Security**
We will never sell your personal data. We will only share your contact information with a Client or Photographer after you have given explicit consent for us to make an introduction. Your data is protected using industry-standard security measures.

### SECTION 3: TERMS FOR PHOTOGRAPHERS (ARTISTS)
By applying to be featured on or accepting an introduction from YesMoment.co, you agree to the following additional terms:
**8. Relationship with the Platform**
* **8.1. Independent Contractor Status:** You are an independent contractor, not an employee or partner of YesMoment.co. You are solely responsible for your own business, equipment, insurance, taxes, and legal compliance.
* **8.2. Future Fees and Monetization:** While the Platform is currently free for Photographers to be featured on, YesMoment.co reserves the right to introduce fees in the future. Such fees may include, but are not limited to, annual listing fees or a commission on Services booked through the Platform. You will be notified in writing of any such changes to the fee structure with reasonable advance notice. Your continued use of the Platform after such notice will constitute your acceptance of the new fees.
* **8.3. No Guarantee of Work:** YesMoment.co makes no representations or warranties regarding the number of potential Clients, job inquiries, or the amount of income you may generate through the Platform. We do not guarantee work or business opportunities.
**9. Content and Intellectual Property**
* **9.1. Content License for Marketing:** You grant YesMoment.co a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, and display your submitted portfolio photos ("Content") for the purpose of operating and promoting the Platform across our website, social media, and other marketing channels.
* **9.2. Content Warranty:** You warrant that you are the exclusive owner of all rights to your Content, and that you have obtained all necessary permissions and model releases from any individuals depicted in the Content.
**10. Liability and Indemnification (CRITICAL)**
* **10.1. Limitation of Liability:** YesMoment.co is an introductory service only. We are not responsible for, and expressly disclaim all liability for, any disputes, claims, losses, or damages of any kind arising from the relationship between you and a Client.
* **10.2. Indemnification:** You agree to **indemnify, defend, and hold harmless** YesMoment.co and its affiliates, officers, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Platform; (b) your violation of these Terms; (c) your provision of services to a Client, including any claims of negligence or malpractice; and (d) your Content infringing on any third-party rights.

**11. Modification of Terms**
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes. What constitutes a material change will be determined at our sole discretion.
